Cómo presentar una apelación

Una apelación es la solicitud a una autoridad superior para que revise una resolución desfavorable sobre su caso. Si desea presentar una apelación de inmigración, debería hablar con un abogado de inmigración para determinar si usted es elegible o no. Quién puede presentarla

La elegibilidad para presentar una apelación de inmigración se determina caso por caso. Usted puede encontrar información acerca de sus derechos de apelación en la comunicación de denegación emitida por parte del USCIS o en la orden del Juez de Inmigración. La notificación de la decisión sobre su caso incluirá información sobre dónde debe presentar la apelación. Si envía su apelación por correo, asegúrese de enviarla a la dirección correcta y mándela con tiempo para que llegue antes de la fecha tope.

Cuándo presentarla

Si desea presentar una apelación, usted debe hacerlo antes de la fecha tope. Generalmente, usted tendrá 30 días desde la fecha en la que el juez emitió su decisión para presentar la apelación. La única extensión disponible es de tres días extra si la decisión es enviada por correo.

Qué presentar

La mayoría de las apelaciones al USCIS se presentan rellenando el Formulario I-290B, Notificación de Moción de Apelación, aunque existen algunas excepciones. La decisión del USCIS indicará qué formulario tiene que rellenar y cuál es la fecha tope para hacerlo. Las denegaciones por parte del Tribunal de Inmigración y las Denegaciones de Fianza son dirigidas a la Junta de Apelaciones de Inmigración (BIA).

Aunque no es obligatorio, usted debería enviar un escrito junto a su solicitud.
