¿Qué es una fianza?

Una fianza es una cantidad de dinero que debe pagarse para que una persona detenida pueda ser puesta en libertad con el fin de que se presentan ante los tribunales. Las fianzas de inmigración son diferentes a los bonos del Estado. Las fianzas de inmigración deben ser pagadas por parte de un Residente Legal Permanente o un ciudadano de los EE.UU. También se puede pagar a través de una compañía de fianzas. Una vez que el gobierno recibe el pago, la persona será puesta en libertad mientras espera y pasa por el proceso de remoción ante un juez de inmigración.

Elegibilidad para la puesta en libertad bajo fianza de inmigración

En general, una persona detenida puede solicitar la libertad bajo fianza de inmigración si no supone un peligro para otros y no corren el riesgo de darse a la fuga. También se tienen en cuenta otros factores.

Algunas personas detenidas no son elegibles para ser puestas en libertad bajo fianza por varias razones, incluyendo:

  • Haber sido condenados por ciertos delitos
  • Haber sido deportados anteriormente y haber vuelto a entrar al país de manera ilegal
  • Estar asociados con bandas (dentro o fuera de los Estados Unidos)

No obstante, cada caso es diferente. La fianza es solo una opción para ser puesto en libertad; el miembro de su familia también puede solicitar la libertad condicional. Estas se otorgan según decisión del Departamento de Seguridad Nacional.

La libertad condicional se puede solicitar al Departamento de Seguridad Nacional mostrando razones humanitarias que justifiquen que la persona debe ser puesta en libertad. Esto puede incluir motivos de salud de la persona detenida o de un miembro de su familia.

Solicitar una audiencia de fianza en Miami

El Departamento de Seguridad Nacional es el primero en determinar una fianza. Si el DHS no ha establecido una fianza, esta se puede solicitar al Juez de Inmigración. La fianza también puede solicitarse antes de ver al Juez de Inmigración presentando una Moción de Fianza. El Juez de Inmigración puede otorgar dicha fianza. Cuando antes envíe la Moción de Fianza al Juez, antes será puesto en libertad, en caso de que la fianza sea aceptada.
