Understanding the Immigration Bond Hearing Process

A bond is an amount of money that must be paid in order for a detainee to be released from custody in order to secure their appearance in court. Immigration Bonds are different from State Bonds. Immigration Bonds must be paid by either a Lawful Permanent Resident or a United States Citizen. You can also pay the bond through a bond company. A bond hearing is separate from a deportation hearing but will likely be held by the same judge. Once the government receives the payment from the bond, the individual will be released from custody while they await and go through removal proceedings before an immigration judge.

Who Is Eligible for Immigration Bonds?

In general, a detainee qualifies for bond if they do not pose a danger to others and if they are not a flight risk. Other factors are determined for bond as well.

Some detainees may find themselves ineligible for a bond for a variety of reasons, including:

  • Being convicted of certain crimes
  • Having previously been deported and re-entered illegally
  • Being associated with gangs (inside or outside the United States)

However, every case is different. Bond is only one option for obtaining release from custody; your family member may be eligible for a parole. Paroles are discretionary by the Department of Homeland Security.

Parole is a request that one can make to the Department of Homeland Security showing humanitarian reasons why the person should be released from custody. This can include health issues of the person detained or a family member.

    The first determination for Bond comes from the Department of Homeland Security. If DHS has not set a Bond, a Bond may be requested from the Immigration Judge. Bond can also be requested prior to seeing an Immigration Judge by filing a Bond Motion. The Immigration Judge may grant a bond. The sooner the Bond Motion is submitted to the Judge, the faster the person will be released from custody, if bond is granted.
